The Messenger of Allah ﷺ said, "A previously married woman has more right to decide about herself than her guardian, and a virgin is to be consulted regarding herself, and her silence is her consent."
حدثنا عبد الرحمن بن مهدي عن مالك عن عبد الله بن الفضل عن نافع بن جبير
قال رسول الله ﷺ الأيم أحق بنفسها من وليها والبكر تستأمر في نفسها وإذنها صماتها
Its isnad is sahih. Abdullah bin Fadl bin Abbas bin Rabia bin Harith bin Abdul-Muttalib is trustworthy, one of the teachers of Malik. The hadith is in Muwatta 2:62-63, and it was narrated by all except Bukhari, as noted in Al-Muntaqa 3458-3461.In Al-Nihaya, "al-ayyim" originally refers to a woman who has no husband, whether she is a virgin or previously married, whether divorced or widowed. What is meant by "al-ayyim" in this hadith is specifically the previously married woman. This is shown by the fact that in some of its narrations "al-thayyib" appears instead of "al-ayyim," as will come at 1897, and it is also shown by its being contrasted with "al-bikr" (the virgin).
