A man was brought before him who had been intimate with his wife's slave girl. He said, "I will judge in your case according to the ruling of the Messenger of Allah ﷺ. If she had made her lawful for you, I will lash you one hundred lashes, and if she had not made her lawful for you, I will stone you."He found that she had indeed made her lawful for him, so he lashed him one hundred lashes.
حدثنا محمد بن جعفر وعبد الله بن بكر قالا حدثنا سعيد عن قتادة عن حبيب بن سالم قال ابن بكر مولى النعمان بن بشير
أنه رفع إليه رجل غشي جارية امرأته فقال لأقضين فيها بقضية رسول الله ﷺ إن كانت أحلتها لك جلدتك مائة جلدة وإن كانت لم تحلها لك رجمتك قال فوجدها قد كانت أحلتها له فجلده مائة
