"I see the blood-money as belonging only to the male agnatic relatives, since they are the ones who pay it on his behalf. Has any of you heard anything from the Messenger of Allah ﷺ regarding this?"Dahhak bin Sufyan al-Kilabi, whom the Messenger of Allah ﷺ had appointed over the bedouins, replied, "The Messenger of Allah ﷺ wrote to me instructing that I give the wife of Ashyam al-Dibabi a share of inheritance from her husband's blood-money."So Umar bin Khattab, may Allah be pleased with him, adopted that ruling.
حدثنا عبد الرزاق حدثنا معمر عن الزهري عن سعيد بن المسيب أن
ما أرى الدية إلا للعصبة لأنهم يعقلون عنه فهل سمع أحد منكم من رسول الله ﷺ في ذلك شيئا فقال الضحاك بن سفيان الكلابي وكان استعمله رسول الله ﷺ على الأعراب كتب إلي رسول الله ﷺ أن أورث امرأة أشيم الضبابي من دية زوجها فأخذ بذلك عمر بن الخطاب رضي الله تعالى عنه
Its isnad is sahih, its narrators being early authorities. The hadith was reported by Abu Dawud, 3/129, no. 2927, in the chapters on inheritance, on a woman inheriting from blood money. Also Tirmidhi, 4/425, no. 2110, similarly, saying, hasan sahih. Also Ibn Majah, 2/883, no. 2642, similarly, and Malik, 2/866, in the chapters on blood money, on what has been said regarding inheritance of blood money.
