The Messenger of Allah ﷺ said, "The neighbor has the greater right to the pre-emption of his neighbor's property. He is to be waited for even if he is absent, when their path is one."
حدثنا هشيم أخبرنا عبد الملك عن عطاء
قال رسول الله ﷺ الجار أحق بشفعة جاره ينتظر بها وإن كان غائبا إذا كان طريقهما واحدا
Its isnad is sahih, and all the jurists have relied on it. Abu Dawud narrated the hadith 3518, in the book of Sales, chapter of Preemption. Ibn Majah narrated it 2494, in the book of Preemption, chapter of Preemption by Neighboring Right. Ibn Abu Shayba narrated it, 7/65, and Baghawi narrated it in Sharh al-Sunnah, 8/242.
