Two women from Huzayl got into a fight, and one of them threw a stone at the other and killed her. They brought their dispute to the Messenger of Allah ﷺ, who ruled that the blood-money for her unborn child was a male or female slave, and he ruled that the blood-money for the woman herself was due from her paternal male relatives, with her children and those with them inheriting from her.Haml bin Malik bin Nabigha al-Huzali said, "Messenger of Allah, how can I be made to pay blood-money for one who neither drank nor ate, neither spoke nor cried out? Such a claim should be dismissed."The Messenger of Allah ﷺ replied, "This man is one of the brothers of the soothsayers," because of the rhymed prose he had spoken.
حدثنا وهب بن بيان وابن السرح قالا حدثنا ابن وهب أخبرني يونس عن ابن شهاب عن سعيد بن المسيب وأبي سلمة
اقتتلت امرأتان من هذيل فرمت إحداهما الأخرى بحجر فقتلتها فاختصموا إلى رسول الله ﷺ فقضى رسول الله ﷺ دية جنينها غرة عبد أو وليدة وقضى بدية المرأة على عاقلتها وورثها ولدها ومن معهم فقال حمل بن مالك بن النابغة الهذلي يا رسول الله كيف أغرم دية من لا شرب ولا أكل لا نطق ولا استهل فمثل ذلك يطل فقال رسول الله ﷺ إنما هذا من إخوان الكهان من أجل سجعه الذي سجع
Bukhari narrated it in the chapter on Diyat, the section on the fetus of a woman and that liability rests on the father, etc., hadith no. 6681 and no. 6910, and Muslim narrated it in the chapter on Qasamah, the section on the diyah for a fetus and the obligation of diyah in unintentional killing, from the hadith of Abdullah bin Wahb, through him.
