A Jewish man and woman committed adultery, both of whom were married, around the time the Messenger of Allah ﷺ arrived in Medina. Stoning had been prescribed for them in the Torah, but they had abandoned it and instead adopted public humiliation. The offender would be struck a hundred times with a rope coated in tar and mounted on a donkey facing its hindquarters.A group of their rabbis gathered and sent some other people to the Messenger of Allah ﷺ, saying, "Ask him about the punishment for adultery."He continued the narration, in which it was said that since they were not adherents of his religion, he was given a choice as to whether to judge between them. Allah said, "So if they come to you, judge between them or turn away from them" [Maidah 5:42].
حدثنا عبد العزيز بن يحيى أبو الأصبغ الحراني حدثني محمد يعني ابن سلمة عن محمد بن إسحق عن الزهري قال سمعت رجلا من مزينة يحدث سعيد بن المسيب
زنى رجل وامرأة من اليهود وقد أحصنا حين قدم رسول الله ﷺ المدينة وقد كان الرجم مكتوبا عليهم في التوراة فتركوه وأخذوا بالتجبيه يضرب مائة بحبل مطلي بقار ويحمل على حمار وجهه مما يلي دبر الحمار فاجتمع أحبار من أحبارهم فبعثوا قوما آخرين إلى رسول الله ﷺ فقالوا سلوه عن حد الزاني وساق الحديث فقال فيه قال ولم يكونوا من أهل دينه فيحكم بينهم فخير في ذلك قال {فإن جاءوك فاحكم بينهم أو أعرض عنهم}
