This is the version of the hadith narrated by Muamar, and it is the more complete one.He said, A Jewish man and woman committed adultery. Some of them said to others, "Let us go to this prophet, for he is a prophet sent with leniency. If he gives us a ruling other than stoning, we will accept it and use it as our argument before Allah, saying, 'It is the ruling of one of your prophets.'"So they came to the Prophet ﷺ while he was sitting among his companions in the mosque and said, "Abu Qasim, what is your view concerning a man and woman who have committed adultery?"He did not say a word to them until he came to their house of study. He stood at the door and said, "I adjure you by Allah, who revealed the Torah to Musa, what do you find in the Torah concerning one who commits adultery while married?"They said, "His face is blackened, he is mounted in disgrace, and he is flogged." Tajbiyah means that the two adulterers are placed on a donkey with their backs to each other and paraded around.A young man among them remained silent. When the Prophet ﷺ saw that he was silent, he pressed him with the adjuration. The young man said, "O Allah, since you have adjured us, we find stoning in the Torah."The Prophet ﷺ asked, "What was the first time you treated Allah's command lightly?"He replied, "A relative of one of our kings committed adultery, and the king delayed the stoning. Then a man from an ordinary family committed adultery, and the king wanted to stone him, but his people stood in his way and said, 'Our man will not be stoned until you bring your man and stone him.' So they agreed among themselves on this punishment as a compromise."The Prophet ﷺ said, "Then I judge by what is in the Torah." He ordered that the two be stoned, and they were stoned.Zuhri said, We have been told that this verse was revealed concerning them, "Indeed, we sent down the Torah, in which was guidance and light. The prophets who submitted judged by it" [Maidah 5:44]. The Prophet ﷺ was among them.
حدثنا محمد بن يحيى حدثنا عبد الرزاق أخبرنا معمر عن الزهري حدثنا رجل من مزينة ح و حدثنا أحمد بن صالح حدثنا عنبسة حدثنا يونس قال قال محمد بن مسلم سمعت رجلا من مزينة ممن يتبع العلم ويعيه ثم اتفقا ونحن عند سعيد بن المسيب فحدثنا
وهذا حديث معمر وهو أتم قال زنى رجل من اليهود وامرأة فقال بعضهم لبعض اذهبوا بنا إلى هذا النبي فإنه نبي بعث بالتخفيف فإن أفتانا بفتيا دون الرجم قبلناها واحتججنا بها عند الله قلنا فتيا نبي من أنبيائك قال فأتوا النبي ﷺ وهو جالس في المسجد في أصحابه فقالوا يا أبا القاسم ما ترى في رجل وامرأة زنيا فلم يكلمهم كلمة حتى أتى بيت مدراسهم فقام على الباب فقال أنشدكم بالله الذي أنزل التوراة على موسى ما تجدون في التوراة على من زنى إذا أحصن قالوا يحمم ويجبه ويجلد والتجبيه أن يحمل الزانيان على حمار وتقابل أقفيتهما ويطاف بهما قال وسكت شاب منهم فلما رآه النبي ﷺ سكت ألظ به النشدة فقال اللهم إذ نشدتنا فإنا نجد في التوراة الرجم فقال النبي ﷺ فما أول ما ارتخصتم أمر الله قال زنى ذو قرابة من ملك من ملوكنا فأخر عنه الرجم ثم زنى رجل في أسرة من الناس فأراد رجمه فحال قومه دونه وقالوا لا يرجم صاحبنا حتى تجيء بصاحبك فترجمه فاصطلحوا على هذه العقوبة بينهم فقال النبي ﷺ فإني أحكم بما في التوراة فأمر بهما فرجما قال الزهري فبلغنا أن هذه الآية نزلت فيهم {إنا أنزلنا التوراة فيها هدى ونور يحكم بها النبيون الذين أسلموا} كان النبي ﷺ منهم
