Abu Bakr bin Abdul-Rahman bin Harith bin Hisham reported that the Messenger of Allah ﷺ said, "If a man sells goods and the buyer then goes bankrupt, and the seller has received nothing of the price, and he finds his goods still intact, then he has the better right to them. But if the buyer dies, then the owner of the goods ranks equally with the other creditors."He continued, "And if the buyer has paid him part of the price, then for what remains he ranks equally with the other creditors. And if any man dies while holding another man's goods still intact, whether he has paid something toward them or paid nothing, the owner ranks equally with the other creditors."
حدثنا محمد بن عوف الطائي حدثنا عبد الله بن عبد الجبار يعني الخبايري حدثنا إسمعيل يعني ابن عياش عن الزبيدي قال أبو داود وهو محمد بن الوليد أبو الهذيل الحمصي عن الزهري عن أبي بكر بن عبد الرحمن عن أبي هريرة عن النبي ﷺ نحوه قال فإن كان قضاه من ثمنها شيئا فما بقي فهو أسوة الغرماء وأيما امرئ هلك وعنده متاع امرئ بعينه اقتضى منه شيئا أو لم يقتض فهو أسوة الغرماء
[Sahih] See no. 3519 and the one after it. Bayhaqi: 6/47 reported it from the hadith of Abu Dawud with this chain, and Ibn Jarud graded it sahih, no. 631. The hadith has corroborating narrations.
