We came to Abu Hurayrah regarding a companion of ours who had become bankrupt. He said, "I will surely judge among you with the judgment of the Messenger of Allah ﷺ. Whoever becomes bankrupt or dies, and a man finds his own goods with him intact, he has the greater right to them."
حدثنا محمد بن بشار حدثنا أبو داود هو الطيالسي حدثنا ابن أبي ذئب عن أبي المعتمر
أتينا أبا هريرة في صاحب لنا أفلس فقال لأقضين فيكم بقضاء رسول الله ﷺ من أفلس أو مات فوجد رجل متاعه بعينه فهو أحق به
[Its chain is hasan] Ibn Majah narrated it in the Judgments, chapter on one who finds his exact property in the possession of a man who has become bankrupt, hadith no. 2360, from the hadith of Muhammad bin Abdul-Rahman bin Abu Dhib, with this wording. It is also found in Musnad Tayalisi, hadith no. 2375. Ibn Jarud graded it sahih, hadith no. 634, as did Hakim, 2/50, and Dhahabi agreed with him.Abu Mutamir was deemed reliable by more than one scholar, who confirmed his hadith as sahih, and he is hasan al-hadith.
