The Messenger of Allah ﷺ said, "The fornicator does not fornicate while he is a believer, and the thief does not steal while he is a believer, but the door of Tawba remains open."
حدثنا أحمد بن منيع حدثنا عبيدة بن حميد عن الأعمش عن أبي صالح
قال رسول الله ﷺ لا يزني الزاني حين يزني وهو مؤمن ولا يسرق السارق حين يسرق وهو مؤمن ولكن التوبة معروضة
Sourcing. Agreed upon [by Bukhari and Muslim]. Bukhari narrated it in Hudud, Chapter on the Sin of Fornicators and the Saying of Allah Almighty, "nor do they commit fornication" [Furqan 25:68], no. 6810, and Muslim narrated it, no. 104/57, from the hadith of Amash with the same wording.On this topic there are also narrations from Ibn Abbas [Bukhari, no. 6782], Ayesha [Ahmad 139/6], and Abdullah bin Abu Awfa [Ahmad 352/4], and so on.Abu Dawud also narrated it, no. 4690, with a slight variation, and its chain is sahih, the hadith "When the slave commits fornication..." Hakim graded it sahih according to the criteria of the two Sheikhs, 22/1, and Dhahabi agreed with him. There is also the report of Abu Jafar Muhammad bin Ali, as well as the hadith of Ali [to come, no. 2626], Ubada bin Samit [mentioned earlier, no. 1439], and Khuzayma bin Thabit [Ahmad 214/5, 215].
