The Messenger of Allah ﷺ sent Muaz to Yemen and asked him, "How will you judge?"Muaz replied, "I will judge according to what is in the Book of Allah."The Prophet asked, "And if it is not in the Book of Allah?"He said, "Then by the Sunnah of the Messenger of Allah ﷺ."The Prophet asked, "And if it is not in the Sunnah of the Messenger of Allah ﷺ?"He said, "Then I will exercise my own judgment."The Prophet said, "Praise be to Allah, who has guided the messenger of the Messenger of Allah ﷺ to what pleases Him."Muhammad bin Bashshar narrated to us, Muhammad bin Jafar and Abdul-Rahman bin Mahdi narrated to us, they said, Shuba narrated to us from Abu Awn, from Harith bin Amr, the nephew of Mughirah bin Shuba, from some people from the inhabitants of Hims, from Muaz, from the Prophet ﷺ, something similar.
حدثنا هناد حدثنا وكيع عن شعبة عن أبي عون الثقفي عن الحارث بن عمرو
أن رسول الله ﷺ بعث معاذا إلى اليمن فقال كيف تقضي فقال أقضي بما في كتاب الله قال فإن لم يكن في كتاب الله قال فبسنة رسول الله ﷺ قال فإن لم يكن في سنة رسول الله ﷺ قال أجتهد رأيي قال الحمد لله الذي وفق رسول رسول الله ﷺ حدثنا محمد بن بشار حدثنا محمد بن جعفر وعبد الرحمن بن مهدي قالا حدثنا شعبة عن أبي عون عن الحارث بن عمرو ابن أخ للمغيرة بن شعبة عن أناس من أهل حمص عن معاذ عن النبي ﷺ نحوه
[Its chain is daif] Abu Dawud also narrated it in "The Book of Judgments," chapter "Exercising Personal Judgment in Rulings," hadith no. 3592, from the hadith of Shuba with the same wording, and Bukhari, Daraqutni, Aqeeli, and others declared it daif. Harith bin Amr is majhul (Taqrib), and the men from among the companions of Muaz are majhul, and there is another defect in it as well.Reference: [Its chain is daif] See the preceding hadith.
