My husband divorced me three times during the lifetime of the Prophet ﷺ, and the Messenger of Allah ﷺ said, "You have no right to lodging or maintenance."Mughirah said, I mentioned this to Ibrahim, and he said, Umar said, "We will not abandon the Book of Allah and the Sunnah of our Prophet ﷺ for the word of a woman, since we do not know whether she remembered correctly or forgot." And Umar used to grant her both lodging and maintenance.Ahmad bin Mani narrated to us, Hushaym narrated to us, Husayn, Ismail, and Mujalid informed us. Hushaym said, Dawud also narrated to us from Shaybi, who said, I visited Fatimah bint Qays and asked her about the ruling of the Messenger of Allah ﷺ in her case. She said, "My husband divorced me irrevocably, and I disputed with him over lodging and maintenance, but the Prophet ﷺ did not grant me lodging or maintenance."In Dawud's version, she said, "And he instructed me to observe my waiting period in the house of Ibn Umm Maktum."
حدثنا هناد حدثنا جرير عن مغيرة عن الشعبي قال
طلقني زوجي ثلاثا على عهد النبي ﷺ فقال رسول الله ﷺ لا سكنى لك ولا نفقة قال مغيرة فذكرته لإبراهيم فقال قال عمر لا ندع كتاب الله وسنة نبينا ﷺ لقول امرأة لا ندري أحفظت أم نسيت وكان عمر يجعل لها السكنى والنفقة حدثنا أحمد بن منيع حدثنا هشيم أنبأنا حصين وإسمعيل ومجالد قال هشيم وحدثنا داود أيضا عن الشعبي قال دخلت على فاطمة بنت قيس فسألتها عن قضاء رسول الله ﷺ فيها فقالت طلقها زوجها البتة فخاصمته في السكنى والنفقة فلم يجعل لها النبي ﷺ سكنى ولا نفقة وفي حديث داود قالت وأمرني أن أعتد في بيت ابن أم مكتوم
Muslim also narrated it in the Book of Divorce, Chapter on the Fact That the Woman Irrevocably Divorced Has No Right to Maintenance, hadith no. 1480, from the hadith of Mughira, in a similar manner.
