Someone asked about a man who divorced his wife while she was menstruating.He replied, "Do you know Abdullah bin Umar? He divorced his wife while she was menstruating, so Umar asked the Prophet ﷺ about it, and he ordered him to take her back."I asked, "Does that pronouncement count as a divorce?"He answered, "Of course. What do you think? If he became incapable or behaved foolishly?"
حدثنا قتيبة حدثنا حماد بن زيد عن أيوب عن محمد بن سيرين عن يونس بن جبير قال
عن رجل طلق امرأته وهي حائض فقال هل تعرف عبد الله بن عمر فإنه طلق امرأته وهي حائض فسأل عمر النبي ﷺ فأمره أن يراجعها قال قلت فيعتد بتلك التطليقة قال فمه أرأيت إن عجز واستحمق
Reference. Agreed upon [by Bukhari and Muslim]. Muslim narrated it in the Book of Divorce, the chapter on the prohibition of divorcing a menstruating woman without her consent, etc., hadith no. 7/1471, from Qutayba, and Bukhari narrated it, hadith no. 5333, through the hadith of Muhammad bin Sirin.
