The Messenger of Allah ﷺ said, "A previously married woman must not be given in marriage until her consent is sought, and a virgin must not be given in marriage until her permission is requested, and her permission is her silence."
حدثنا إسحق بن منصور أخبرنا محمد بن يوسف حدثنا الأوزاعي عن يحيى بن أبي كثير عن أبي سلمة
قال رسول الله ﷺ لا تنكح الثيب حتى تستأمر ولا تنكح البكر حتى تستأذن وإذنها الصموت
Agreed upon (by Bukhari and Muslim). Muslim narrated it in "Nikah," chapter on seeking permission of the previously married woman for marriage by speech, and of the virgin by silence, hadith no. 1419, from the hadith of Uzai, and Bukhari, hadith no. 5136, from the hadith of Yahya bin Abu Kathir, with the same wording.On this subject there are also narrations from Umar [Tabarani in Al-Kabir, 1/73–74, hadith no. 88], Ibn Abbas [to come, no. 1108], Ayesha [Bukhari, hadith no. 6946, and Muslim, hadith no. 1420], and Urs bin Umayrah [Bayhaqi, 7/123].
