The Messenger of Allah ﷺ said, "If he becomes intoxicated, flog him. Then if he becomes intoxicated again, flog him. Then if he becomes intoxicated again, flog him." Then he said regarding the fourth time, "Strike his neck."
أخبرنا إسحق بن إبراهيم قال حدثنا شبابة قال حدثنا ابن أبي ذئب عن خاله الحارث بن عبد الرحمن عن أبي سلمة
عن رسول الله ﷺ قال إذا سكر فاجلدوه ثم إن سكر فاجلدوه ثم إن سكر فاجلدوه ثم قال في الرابعة فاضربوا عنقه
[Its chain is sahih] Ibn Majah narrated it in the Book of Legal Punishments, chapter on the one who drinks wine repeatedly, hadith 2572, from the hadith of Shababa bin Sawwar through this same route, and it is also in Kubra, hadith 5172. Ibn Jarud graded it sahih, hadith 831, as did Ibn Hibban, hadith 1517, and Hakim graded it as meeting the standard of Muslim, 4/371, and Dhahabi agreed with him.
