A group from the Kalai tribe brought before him some weavers, accusing them of stealing goods. He detained them for several days, then released them. The accusers came to him and said, "You have released them without interrogation or beating?"Numan replied, "Whatever you wish. If you want, I will flog them, and if Allah brings out your goods through that, well and good. Otherwise, I will take the same number of lashes from your own backs."They said, "Is this your judgment?"He answered, "This is the judgment of Allah and His Messenger ﷺ."
أخبرنا إسحق بن إبراهيم قال حدثنا بقية بن الوليد قال حدثني صفوان بن عمرو قال حدثني أزهر بن عبد الله الحرازي
أنه رفع إليه نفر من الكلاعيين أن حاكة سرقوا متاعا فحبسهم أياما ثم خلى سبيلهم فأتوه فقالوا خليت سبيل هؤلاء بلا امتحان ولا ضرب فقال النعمان ما شئتم إن شئتم أضربهم فإن أخرج الله متاعكم فذاك وإلا أخذت من ظهوركم مثله قالوا هذا حكمك قال هذا حكم الله عز وجل ورسوله ﷺ
[Its chain is daif] Abu Dawud narrated it, chapter on Hudud, section on testing by beating, no. 4382, from the hadith of Baqiyyah with this wording, and it is also in Kubra, no. 7361. Azhar bin Abdullah, there is doubt about Abdullah's having heard it from Numan bin Bashir, though if his having heard it is established, then his hadith is hasan.
