Two co-wives quarreled, and one of them struck the other with a tent pole and killed her. The Messenger of Allah ﷺ ruled that the blood-money was due from the killer's paternal male relatives, and he ruled that for the child in her womb a slave, male or female, must be given.The Arabi protested, "Am I to pay compensation for one who neither ate, nor drank, nor cried out, nor even drew breath? Surely such a claim should be dismissed."The Messenger of Allah ﷺ replied, "This is rhymed speech like the rhymed speech of the days of ignorance," and he upheld his ruling that a slave be given for the child in her womb.
أخبرنا محمد بن بشار قال حدثنا عبد الرحمن قال حدثنا سفيان عن منصور عن إبراهيم عن عبيد بن نضيلة
أن ضرتين ضربت إحداهما الأخرى بعمود فسطاط فقتلتها فقضى رسول الله ﷺ بالدية على عصبة القاتلة وقضى لما في بطنها بغرة فقال الأعرابي تغرمني من لا أكل ولا شرب ولا صاح فاستهل فمثل ذلك يطل فقال سجع كسجع الجاهلية وقضى لما في بطنها بغرة
