A man was killed during the time of the Messenger of Allah ﷺ, and the killer was brought before the Prophet ﷺ, who handed him over to the guardian of the slain man.The killer said, "Messenger of Allah, by Allah, I did not intend to kill him."The Messenger of Allah ﷺ said to the guardian of the slain man, "If he is telling the truth and you kill him, you will enter the Fire."So he let him go. The man had been tied up with a leather strap, and he went out dragging his strap behind him, and so he was named Dhu an-Nisah, the man of the strap.
أخبرنا محمد بن العلاء وأحمد بن حرب واللفظ لأحمد قالا حدثنا أبو معاوية عن الأعمش عن أبي صالح
قتل رجل على عهد رسول الله ﷺ فرفع القاتل إلى النبي ﷺ فدفعه إلى ولي المقتول فقال القاتل يا رسول الله لا والله ما أردت قتله فقال رسول الله ﷺ لولي المقتول أما إنه إن كان صادقا ثم قتلته دخلت النار فخلى سبيله قال وكان مكتوفا بنسعة فخرج يجر نسعته فسمي ذا النسعة
[Sahih] Reported by Abu Dawud, in the Book of Blood Money, Chapter on the Leader Ordering Pardon Regarding Bloodshed, no. 4498, from the hadith of Abu Muawiya al-Darir, with this wording. Tirmidhi said, no. 1407, hasan sahih, and it is also in Sunan al-Kubra, no. 6924. Amash used an ambiguous transmission formula (an'ana). The hadith has corroborating narrations in Muslim, no. 1680, and elsewhere.
