Usayd reported that he was the governor of al-Yamamah, and Marwan wrote to him that Muawiya had written to him saying that any man from whom something was stolen has the greater right to it wherever he finds it. Marwan then wrote to me with this instruction.So I wrote back to Marwan saying that the Prophet ﷺ ruled that if the person who purchased the stolen item from the thief was not under suspicion, the owner is given a choice. If he wishes, he may take from the buyer the price he paid for it, or if he wishes, he may pursue the thief himself. Abu Bakr, Umar, and Uthman then ruled the same way.Marwan sent my letter to Muawiya, and Muawiya wrote back to Marwan, "Neither you nor Usayd may pass judgment over me. Rather, I pass judgment in matters where I have been given authority over you both. So carry out what I have commanded you."Marwan sent Muawiya's letter to me, and I said, "I will not, for as long as I hold this office, rule by what Muawiya has said."

أنه كان عاملا على اليمامة وأن مروان كتب إليه أن معاوية كتب إليه أن أيما رجل سرق منه سرقة فهو أحق بها حيث وجدها ثم كتب بذلك مروان إلي فكتبت إلى مروان أن النبي ﷺ قضى بأنه إذا كان الذي ابتاعها من الذي سرقها غير متهم يخير سيدها فإن شاء أخذ الذي سرق منه بثمنها وإن شاء اتبع سارقه ثم قضى بذلك أبو بكر وعمر وعثمان فبعث مروان بكتابي إلى معاوية وكتب معاوية إلى مروان إنك لست أنت ولا أسيد تقضيان علي ولكني أقضي فيما وليت عليكما فأنفذ لما أمرتك به فبعث مروان بكتاب معاوية فقلت لا أقضي به ما وليت بما قال معاوية
