The Messenger of Allah ﷺ ruled that if a man finds his stolen property in the possession of someone not suspected of theft, he may either take it back by paying what that person paid for it, or pursue the thief instead. Abu Bakr and Umar issued the same ruling.
أخبرني هارون بن عبد الله قال حدثنا حماد بن مسعدة عن ابن جريج عن عكرمة بن خالد قال
أن رسول الله ﷺ قضى أنه إذا وجدها في يد الرجل غير المتهم فإن شاء أخذها بما اشتراها وإن شاء اتبع سارقه وقضى بذلك أبو بكر وعمر
