The Messenger of Allah ﷺ said, "There is no valid sale binding upon a man for something he does not own."
أخبرنا عثمان بن عبد الله قال حدثنا سعيد بن سليمان عن عباد بن العوام عن سعيد بن أبي عروبة عن أبي رجاء قال عثمان هو محمد بن سيف عن مطر الوراق
قال رسول الله ﷺ ليس على رجل بيع فيما لا يملك
[Its chain of transmission is hasan]. Abu Dawud narrated it in the Book of Divorce, chapter on divorce before marriage, no. 2179/0, from the hadith of Matar al-Warraq through this route, and it is also in al-Kubra, vol. 6205. The hadith has many routes of transmission found in Tirmidhi, Ahmad, and al-Hakim, 2:204–205.
