Urwa bin Zubayr reported,

Zayd bin Thabit said, "May Allah forgive Rafi bin Khadij. By Allah, I know the hadith better than he does. There were two men who got into a fight, and the Messenger of Allah ﷺ said, 'If this is how you behave, then do not lease out farmland.' So Rafi only heard the words, 'Do not lease out farmland.'"Abu Abdul-Rahman said, A written sharecropping contract in which the seed and expenses are borne by the landowner, and the cultivator receives one-quarter of what Allah produces from it.This is a document drawn up by so-and-so, son of so-and-so, son of so-and-so, while in sound health and with full legal capacity, on behalf of so-and-so, son of so-and-so. You have handed over to me the entirety of your land located at such-and-such place in the city of such-and-such for sharecropping. It is the land known as such-and-such, bounded by four boundaries that fully enclose it. The first of these boundaries in its entirety adjoins such-and-such, and the second, third, and fourth likewise.You have handed over to me the entirety of this land bounded as described in this document, with its enclosing boundaries and all its rights, water rights, canals, and irrigation channels, as bare, empty land containing no plantings or crops, for one full year. Its beginning is the start of the month of such-and-such of the year such-and-such, and its end is the close of the month of such-and-such of the year such-and-such.The terms are that I shall cultivate the entirety of this land bounded in this document, the location of which is described herein, throughout this stipulated year from its beginning to its end, with whatever I wish and choose to plant in it of wheat, barley, sesame, rice, cotton, fresh fodder, broad beans, chickpeas, cowpeas, lentils, gourds, melons, carrots, turnips, radishes, onions, garlic, herbs, aromatic plants, and all other crops, both winter and summer. This shall be done with your seeds and your seed stock, all of which is your responsibility, not mine.I am to undertake this with my own hand and with whomever I wish of my helpers, hired workers, oxen, and tools. I shall attend to the cultivation, upkeep, and all that promotes its growth and improvement, including plowing the land, clearing its weeds, irrigating whatever of the planted crops requires irrigation, fertilizing whatever requires fertilizing, digging its irrigation channels and canals, harvesting whatever is to be harvested from it, gathering it, threshing whatever is to be threshed, and winnowing it. The expenses for all of this fall upon you, not me, while I perform all of the labor with my own hand and my helpers, not you.You shall receive, of everything that Allah produces from all of this during the period described in this document from its beginning to its end, three-quarters as the share of your land, your water, your seed, and your expenses, and I shall receive the remaining quarter of all of it as compensation for my cultivation, labor, and personal supervision with my hand and my helpers.You have handed over to me all of this land bounded in this document with all its rights and appurtenances, and I have taken possession of all of it from you on such-and-such day of such-and-such month of such-and-such year. All of it has thus come into my possession on your behalf. I hold no ownership in any of it, nor any claim or demand, except for this sharecropping arrangement described in this document for the year specified herein. When the term expires, all of it shall be returned to you and to your possession, and you have the right after its expiry to remove me from it and to take it out of my hands and out of the hands of anyone who has acquired possession of it through me.So-and-so and so-and-so have acknowledged this, and this document has been written in two copies.

عن عروة بن الزبير قال

قال زيد بن ثابت يغفر الله لرافع بن خديج أنا والله أعلم بالحديث منه إنما كانا رجلين اقتتلا فقال رسول الله ﷺ إن كان هذا شأنكم فلا تكروا المزارع فسمع قوله لا تكروا المزارع قال أبو عبد الرحمن كتابة مزارعة على أن البذر والنفقة على صاحب الأرض وللمزارع ربع ما يخرج الله عز وجل منها هذا كتاب كتبه فلان بن فلان بن فلان في صحة منه وجواز أمر لفلان بن فلان إنك دفعت إلي جميع أرضك التي بموضع كذا في مدينة كذا مزارعة وهي الأرض التي تعرف بكذا وتجمعها حدود أربعة يحيط بها كلها وأحد تلك الحدود بأسره لزيق كذا والثاني والثالث والرابع دفعت إلي جميع أرضك هذه المحدودة في هذا الكتاب بحدودها المحيطة بها وجميع حقوقها وشربها وأنهارها وسواقيها أرضا بيضاء فارغة لا شيء فيها من غرس ولا زرع سنة تامة أولها مستهل شهر كذا من سنة كذا وآخرها انسلاخ شهر كذا من سنة كذا على أن أزرع جميع هذه الأرض المحدودة في هذا الكتاب الموصوف موضعها فيه هذه السنة المؤقتة فيها من أولها إلى آخرها كل ما أردت وبدا لي أن أزرع فيها من حنطة وشعير وسماسم وأرز وأقطان ورطاب وباقلا وحمص ولوبيا وعدس ومقاثي ومباطيخ وجزر وشلجم وفجل وبصل وثوم وبقول ورياحين وغير ذلك من جميع الغلات شتاء وصيفا ببزورك وبذرك وجميعه عليك دوني على أن أتولى ذلك بيدي وبمن أردت من أعواني وأجرائي وبقري وأدواتي وإلى زراعة ذلك وعمارته والعمل بما فيه نماؤه ومصلحته وكراب أرضه وتنقية حشيشها وسقي ما يحتاج إلى سقيه مما زرع وتسميد ما يحتاج إلى تسميده وحفر سواقيه وأنهاره واجتناء ما يجتنى منه والقيام بحصاد ما يحصد منه وجمعه ودياسة ما يداس منه وتذريته بنفقتك على ذلك كله دوني وأعمل فيه كله بيدي وأعواني دونك على أن لك من جميع ما يخرج الله عز وجل من ذلك كله في هذه المدة الموصوفة في هذا الكتاب من أولها إلى آخرها فلك ثلاثة أرباعه بحظ أرضك وشربك وبذرك ونفقاتك ولي الربع الباقي من جميع ذلك بزراعتي وعملي وقيامي على ذلك بيدي وأعواني ودفعت إلي جميع أرضك هذه المحدودة في هذا الكتاب بجميع حقوقها ومرافقها وقبضت ذلك كله منك يوم كذا من شهر كذا من سنة كذا فصار جميع ذلك في يدي لك لا ملك لي في شيء منه ولا دعوى ولا طلبة إلا هذه المزارعة الموصوفة في هذا الكتاب في هذه السنة المسماة فيه فإذا انقضت فذلك كله مردود إليك وإلى يدك ولك أن تخرجني بعد انقضائها منها وتخرجها من يدي ويد كل من صارت له فيها يد بسببي أقر فلان وفلان وكتب هذا الكتاب نسختين
