I said to her, "Tell me your story."She said, "I obtained a divorce from my husband by mutual settlement, then I came to Uthman and asked him what waiting period was required of me. He said, 'No waiting period is required of you, unless you have recently been intimate with him, in which case you should wait until you have one menstrual cycle. In this I am following the ruling of the Messenger of Allah ﷺ regarding Maryam al-Mughaliyah, who was married to Thabit bin Qays bin Shammas and obtained a divorce from him by mutual settlement.'"
أخبرنا عبيد الله بن سعد بن إبراهيم بن سعد قال حدثنا عمي قال حدثنا أبي عن ابن إسحق قال حدثني عبادة بن الوليد بن عبادة بن الصامت
قلت لها حدثيني حديثك قالت اختلعت من زوجي ثم جئت عثمان فسألته ماذا علي من العدة فقال لا عدة عليك إلا أن تكوني حديثة عهد به فتمكثي حتى تحيضي حيضة قال وأنا متبع في ذلك قضاء رسول الله ﷺ في مريم المغالية كانت تحت ثابت بن قيس بن شماس فاختلعت منه
Its chain is hasan. Ibn Majah narrated it in the chapter on Divorce, the section on the waiting period of a woman who obtains khula, no. 2058, from the hadith of Yaqub bin Ibrahim bin Saad, from Ubaydullah, through this chain. It is also found in al-Kubra, no. 5692.
