They were on a journey, some of them in the state of ihram and some not. He said, "I saw a wild donkey, so I mounted my horse and took up my spear. I asked them to help me, but they refused to assist me. So I snatched a whip from one of them, charged at the donkey, and struck it down. They ate from it, but then they grew uneasy about what they had done."The Prophet ﷺ was asked about it.He said, "Did you point it out to him or assist him in any way?"They replied, "No."He said, "Then eat."
أخبرنا محمود بن غيلان قال حدثنا أبو داود قال أنبأنا شعبة قال أخبرني عثمان بن عبد الله بن موهب قال سمعت
أنهم كانوا في مسير لهم بعضهم محرم وبعضهم ليس بمحرم قال فرأيت حمار وحش فركبت فرسي وأخذت الرمح فاستعنتهم فأبوا أن يعينوني فاختلست سوطا من بعضهم فشددت على الحمار فأصبته فأكلوا منه فأشفقوا قال فسئل عن ذلك النبي ﷺ فقال هل أشرتم أو أعنتم قالوا لا قال فكلوا
Muslim narrated this in the Book of Hajj, in the chapter titled "The Prohibition of Hunting for One in the State of Ihram," hadith no. 61/1196, on the authority of Shubah. Bukhari narrated it in the Book of the Penalty for Game, in the chapter titled "One in the State of Ihram Should Not Point Toward Game So That Someone Not in Ihram May Hunt It," hadith no. 1824, on the authority of Uthman with the same wording. It is also recorded in Sunan al-Kubra, hadith no. 3809.
