Aishah wanted to buy Barirah and set her free, but the sellers stipulated that the right of guardianship would remain with them. She mentioned this to the Messenger of Allah ﷺ, who said, "Buy her and free her, for the right of guardianship belongs to the one who frees the slave."Barirah was given the choice regarding her marriage when she was freed.Some meat was brought to the Messenger of Allah ﷺ, and it was said, "This is part of what was given in charity to Barirah."He replied, "It is charity for her, but a gift to us."Her husband was a free man.
أخبرنا عمرو بن يزيد قال حدثنا بهز بن أسد قال حدثنا شعبة قال حدثنا الحكم عن إبراهيم عن الأسود
أنها أرادت أن تشتري بريرة فتعتقها وإنهم اشترطوا ولاءها فذكرت ذلك لرسول الله ﷺ فقال اشتريها وأعتقيها فإن الولاء لمن أعتق وخيرت حين أعتقت وأتي رسول الله ﷺ بلحم فقيل هذا مما تصدق به على بريرة فقال هو لها صدقة ولنا هدية وكان زوجها حرا
Bukhari transmitted it, Zakat, chapter on giving charity to the freed slaves of the Prophet's wives, no. 1493, and so on, no. 1075, and Muslim, Zakat, chapter on the permissibility of gifts for the Prophet and for Banu Hashim and Banu Muttalib, the hadith of Shubah with this chain, and it is in Kubra, no. 2396.His statement, "and her husband was free," is from the words of Aswad, may Allah have mercy on him, and it is shadhdh, an error on his part, and the correct version is, "and her husband was a slave."
