Ubaydullah bin Abdullah bin Utba reported,

Abu Amr bin Hafs bin Mughira set out with Ali bin Abu Talib to Yemen. He sent word to his wife Fatimah bint Qays pronouncing the final divorce that remained of her divorces, and he instructed Harith bin Hisham and Ayyash bin Abu Rabia to provide her with maintenance.They said to her, "By Allah, you are not entitled to maintenance unless you are pregnant."So she went to the Prophet ﷺ and told him what they had said.He said, "You are not entitled to maintenance."She then asked his permission to move from her home, and he granted her permission.She asked, "Where shall I go, Messenger of Allah?"He replied, "To Ibn Umm Maktum." He was blind, so she could remove her outer garments in his presence without his seeing her.When her waiting period ended, the Prophet ﷺ gave her in marriage to Usama bin Zayd.Later, Marwan sent Qabisa bin Zuayb to her to ask her about this hadith, and she related it to him.Marwan said, "We have not heard this hadith except from a woman. We will hold to the established practice we have found people following."When Marwan's words reached Fatimah, she said, "Then the Quran is the judge between me and you. Allah says, 'Do not expel them from their houses' [Talaq 65:1] — the verse. She continued, "This applies to one whose husband can still take her back. What new matter could arise after three pronouncements of divorce? How can you say she has no maintenance if she is not pregnant? On what grounds, then, do you confine her?"

أن أبا عمرو بن حفص بن المغيرة خرج مع علي بن أبي طالب إلى اليمن فأرسل إلى امرأته فاطمة بنت قيس بتطليقة كانت بقيت من طلاقها وأمر لها الحارث بن هشام وعياش بن أبي ربيعة بنفقة فقالا لها والله ما لك نفقة إلا أن تكوني حاملا فأتت النبي ﷺ فذكرت له قولهما فقال لا نفقة لك فاستأذنته في الانتقال فأذن لها فقالت أين يا رسول الله فقال إلى ابن أم مكتوم وكان أعمى تضع ثيابها عنده ولا يراها فلما مضت عدتها أنكحها النبي ﷺ أسامة بن زيد فأرسل إليها مروان قبيصة بن ذؤيب يسألها عن الحديث فحدثته به فقال مروان لم نسمع هذا الحديث إلا من امرأة سنأخذ بالعصمة التي وجدنا الناس عليها فقالت فاطمة حين بلغها قول مروان فبيني وبينكم القرآن قال الله عز وجل {لا تخرجوهن من بيوتهن} الآية قالت هذا لمن كانت له مراجعة فأي أمر يحدث بعد الثلاث فكيف تقولون لا نفقة لها إذا لم تكن حاملا فعلام تحبسونها
