A man of the Ansar named Uhayha bin Julah had a young paternal uncle who was younger than Uhayha himself, and the boy was being raised among his maternal relatives. Uhayha seized him and killed him.His maternal relatives said, "We were the ones who fed him and cared for him until he grew to his full stature, and then a man's claim over his uncle prevailed against us."Urwa said, "It is for this reason that a killer does not inherit from the one he has killed."
و حدثني مالك عن يحيى بن سعيد
أن رجلا من الأنصار يقال له أحيحة بن الجلاح كان له عم صغير هو أصغر من أحيحة وكان عند أخواله فأخذه أحيحة فقتله فقال أخواله كنا أهل ثمه ورمه حتى إذا استوى على عممه غلبنا حق امرئ في عمه قال عروة فلذلك لا يرث قاتل من قتل
