He said that he had seized a runaway slave who had committed a theft, and the matter puzzled him. So he wrote about it to Umar bin Abdul-Aziz, who was the governor at that time, asking him about it. He told him, "I used to hear that when a runaway slave steals while he is in flight, his hand is not cut off."Umar bin Abdul-Aziz wrote back to him in reply to his letter, saying, "You wrote to me that you used to hear that when a runaway slave steals, his hand is not cut off. But Allah says in His Book, 'As for the thief, male or female, cut off their hands as a recompense for what they have earned, an exemplary punishment from Allah. And Allah is Mighty, Wise' [Maidah 5:38]. So if what he stole amounts to a quarter of a dinar or more, cut off his hand."
و حدثني عن مالك
أنه أخذ عبدا آبقا قد سرق قال فأشكل علي أمره قال فكتبت فيه إلى عمر بن عبد العزيز أسأله عن ذلك وهو الوالي يومئذ قال فأخبرته أنني كنت أسمع أن العبد الآبق إذا سرق وهو آبق لم تقطع يده قال فكتب إلي عمر بن عبد العزيز نقيض كتابي يقول كتبت إلي أنك كنت تسمع أن العبد الآبق إذا سرق لم تقطع يده وإن الله تبارك وتعالى يقول في كتابه {والسارق والسارقة فاقطعوا أيديهما جزاء بما كسبا نكالا من الله والله عزيز حكيم} فإن بلغت سرقته ربع دينار فصاعدا فاقطع يده
