A man named Misbah asked a son of his for help, and it seemed to him that the boy was slow in coming. When the boy came, the father said to him, "You fornicator!"Zurayq said, "The son then sought my help against him. But when I was about to flog the father, the son said, 'By Allah, if you flog him, I will confess fornication against myself.'"When he said that, the case became unclear to me, so I wrote about it to Umar bin Abdul-Aziz, who was the governor at that time, informing him of the matter. Umar wrote back to me telling me to accept the son's pardon."Zurayq said, "I also wrote to Umar bin Abdul-Aziz asking, 'What is your view concerning a man who is slandered himself, or whose parents are slandered when they have died, or one of them has died?'"Umar wrote back to me, 'If he pardons the slander against himself, then accept his pardon. But if his parents are slandered when they have died, or one of them has died, then exact the penalty for him according to the Book of Allah, unless he prefers to let the matter be covered up.'"

أن رجلا يقال له مصباح استعان ابنا له فكأنه استبطأه فلما جاءه قال له يا زان قال زريق فاستعداني عليه فلما أردت أن أجلده قال ابنه والله لئن جلدته لأبوءن على نفسي بالزنا فلما قال ذلك أشكل علي أمره فكتبت فيه إلى عمر بن عبد العزيز وهو الوالي يومئذ أذكر له ذلك فكتب إلي عمر أن أجز عفوه قال زريق وكتبت إلى عمر بن عبد العزيز أيضا أرأيت رجلا افتري عليه أو على أبويه وقد هلكا أو أحدهما قال فكتب إلي عمر إن عفا فأجز عفوه في نفسه وإن افتري على أبويه وقد هلكا أو أحدهما فخذ له بكتاب الله إلا أن يريد سترا
