Thawr bin Zayd Deeli reported,

The Messenger of Allah ﷺ said, "Any house or land that was divided in the days of ignorance remains according to the division of that time, and any house or land that Islam came upon before it was divided is to be divided according to the division of Islam."

حدثني يحيى عن مالك

عن ثور بن زيد الديلي أنه قال بلغني

أن رسول الله ﷺ قال أيما دار أو أرض قسمت في الجاهلية فهي على قسم الجاهلية وأيما دار أو أرض أدركها الإسلام ولم تقسم فهي على قسم الإسلام
