Rafi bin Khadij married the daughter of Muhammad bin Maslama Ansari. She remained with him until she grew old, and then he married a young woman alongside her and began to favor the younger wife over her. So she pressed him for a divorce, and he divorced her once. Then he left her until she was nearly free of him, at which point he took her back.Afterward he again favored the young woman, so she pressed him for a divorce, and he divorced her once and then took her back.Then he again favored the young woman, and she pressed him for a divorce.He said, "As you wish. Only one divorce remains. If you wish, you may stay on as you are, with the preference you see being given, and if you wish, I will part from you."She replied, "No, I will stay on despite the preference."So he kept her on those terms, and Rafi saw no sin in it for himself, since she had chosen to remain with him despite his favoring the other.
و حدثني عن مالك
عن رافع بن خديج أنه تزوج بنت محمد بن مسلمة الأنصاري فكانت عنده حتى كبرت فتزوج عليها فتاة شابة فآثر الشابة عليها فناشدته الطلاق فطلقها واحدة ثم أمهلها حتى إذا كادت تحل راجعها ثم عاد فآثر الشابة فناشدته الطلاق فطلقها واحدة ثم راجعها ثم عاد فآثر الشابة فناشدته الطلاق فقال ما شئت إنما بقيت واحدة فإن شئت استقررت على ما ترين من الأثرة وإن شئت فارقتك قالت بل أستقر على الأثرة فأمسكها على ذلك ولم ير رافع عليه إثما حين قرت عنده على الأثرة
