Malik reported,

Saeed bin Musayab and Sulayman bin Yasar were both asked about a man who married off a slave girl of his to a slave of his, and then the slave pronounced an irrevocable divorce upon her, after which her master gave her to him as a gift. Does she become lawful for him through ownership?They both replied, "She is not lawful for him until she marries another husband."

عن مالك، أنه بلغه

أن سعيد بن المسيب، وسليمان بن يسار، سئلا عن رجل زوج عبدا له جارية، فطلقها العبد البتة، ثم وهبها سيدها له، هل تحل له بملك اليمين؟ فقالا: لا تحل له حتى تنكح زوجا غيره.
