The Messenger of Allah ﷺ ruled that the compensation for a miscarried fetus is a male or female slave. The man against whom this judgment was given said, "Should I pay compensation for one who has neither drunk nor eaten, neither cried nor made a sound? Such a one should be disregarded."The Messenger of Allah ﷺ replied, "This man speaks like a poet. The compensation for it is a male or female slave."
حدثنا أبو بكر بن أبي شيبة حدثنا محمد بن بشر عن محمد بن عمرو عن أبي سلمة
قضى رسول الله ﷺ في الجنين بغرة عبد أو أمة فقال الذي قضي عليه أنعقل من لا شرب ولا أكل ولا صاح ولا استهل ومثل ذلك يطل فقال رسول الله ﷺ إن هذا ليقول بقول شاعر فيه غرة عبد أو أمة
[Its isnad is hasan] Tirmidhi narrated it in the Diyat, chapter on what has been said regarding the diyah for a fetus, from the hadith of Muhammad bin Amr, through the same chain, and he said, hasan sahih.
