A woman was forced into intercourse during the time of the Messenger of Allah ﷺ, so he waived the prescribed punishment from her and carried it out against the man who assaulted her. The narrator did not mention that he assigned her a dowry.
حدثنا علي بن ميمون الرقي وأيوب بن محمد الوزان وعبد الله بن سعيد قالوا حدثنا معمر بن سليمان أنبأنا الحجاج بن أرطاة
استكرهت امرأة على عهد رسول الله ﷺ فدرأ عنها الحد وأقامه على الذي أصابها ولم يذكر أنه جعل لها مهرا
[Its chain of transmission is daif]Reported by Tirmidhi in the Hudud chapter, section on what has been said regarding a woman who is forced into zina, hadith no. 1453, from the hadith of Mamar bin Sulayman, with this chain. It has two defects, the first being the weakness of Hajjaj, mentioned previously at hadith nos. 496, 1129, 2587, and the second being the disconnection between Abdul-Jabbar and his father, see hadith no. 855.
