I would not pay blood-money for anyone on whom I had carried out a prescribed punishment, except for the one who drinks wine, for the Messenger of Allah ﷺ did not establish a fixed punishment for it. It is something we ourselves instituted.
حدثنا إسمعيل بن موسى حدثنا شريك عن أبي حصين عن عمير بن سعيد ح و حدثنا عبد الله بن محمد الزهري حدثنا سفيان بن عيينة حدثنا مطرف سمعته عن عمير بن سعيد قال
ما كنت أدي من أقمت عليه الحد إلا شارب الخمر فإن رسول الله ﷺ لم يسن فيه شيئا إنما هو شيء جعلناه نحن
Bukhari narrated it in the Book of Hudud, Chapter on Striking with Palm Branches and Sandals, hadith 6778, and Muslim in the Book of Hudud, Chapter on the Punishment for Wine, hadith 1707, from the hadith of Abu Husayn through him.
