A man bought a slave and made use of his labor, then discovered a defect in him and returned him. The man said, "Messenger of Allah, he has used my slave's labor."The Messenger of Allah ﷺ said, "The benefit goes with the liability."
حدثنا هشام بن عمار حدثنا مسلم بن خالد الزنجي حدثنا هشام بن عروة عن أبيه
أن رجلا اشترى عبدا فاستغله ثم وجد به عيبا فرده فقال يا رسول الله إنه قد استغل غلامي فقال رسول الله ﷺ الخراج بالضمان
[Its chain of transmission is daif] Abu Dawud transmitted it in "Bay" the previous chapter, no: 3510, from the hadith of Muslim Zanji, with this wording, and Ibn Jarud graded it sahih, no: 626, as did Ibn Hibban (Mawarid), no: 1126, and Hakim, 2/15, and Dhahabi, though Dhahabi also found fault with it.
