The Messenger of Allah ﷺ said, "There is no divorce in what one does not own."

Its isnad is hasan. Tirmidhi narrated it in the chapter on Divorce, the section titled "There is no divorce before marriage," hadith no. 1181, through Hushaym, and Abu Dawud narrated it in the chapter on Divorce, the section on divorce before marriage, hadith nos. 2191 and 2192, from the report of Abdul-Rahman bin Harith, both of them from Amr bin Shuayb with this wording. Tirmidhi said, "hasan sahih." The wording of Hakim, 22/205, is "There is no divorce before marriage," and Dhahabi graded it sahih. The wording of Abu Dawud is "and no manumission except in what one owns."
