Ayesha reported,

The Messenger of Allah ﷺ said, "The virgin must be asked for permission."I said, "The virgin feels shy."He replied, "Her silence is her consent."Some people have said that if a man desires an orphan girl or a virgin and she refuses, and he then resorts to a trick by bringing two false witnesses to testify that he had married her, and she later reaches maturity and the orphan girl agrees, and the judge accepts the false testimony while the husband knows the testimony is invalid, intercourse is lawful for him.

حدثنا أبو عاصم عن ابن جريج عن ابن أبي مليكة عن ذكوان

عن عائشة رضي الله عنها قالت

قال رسول الله ﷺ البكر تستأذن قلت إن البكر تستحيي قال إذنها صماتها وقال بعض الناس إن هوي رجل جارية يتيمة أو بكرا فأبت فاحتال فجاء بشاهدي زور على أنه تزوجها فأدركت فرضيت اليتيمة فقبل القاضي شهادة الزور والزوج يعلم ببطلان ذلك حل له الوطء
