The Messenger of Allah ﷺ said, "A previously married woman shall not be given in marriage until her express consent is sought, and a virgin shall not be given in marriage until her permission is sought."They asked, "How does she give her permission?"He replied, "By her silence."Some people have said that if a man contrives, by means of two false witnesses, to have it established that he married a previously married woman with her consent, and the judge then confirms the marriage between them, while the husband himself knows full well that he never actually married her, this marriage is nonetheless valid for him, and there is no harm in his living with her as her husband.
