Abu Hurairah reported,

Khuza killed a man.Abdullah bin Raja said, Harb narrated to us from Yahya, who said, Abu Salama narrated to us, who said, Abu Hurairah narrated to us that in the year of the conquest of Mecca, Khuza killed a man from Banu Layth in revenge for one of their own who had been killed during the days of ignorance.The Messenger of Allah ﷺ then stood and said, "Allah held back the elephant from Mecca and gave His Messenger and the believers authority over its people. Know that it was not made lawful for anyone before me, nor will it be lawful for anyone after me. It was made lawful for me only for a single hour of the day. Know that at this very hour of mine it is sacred. Its thorny shrubs are not to be cut, its trees are not to be felled, and its lost property is not to be picked up except by one who will announce it publicly. Whoever has a relative killed has the better of two choices, either to receive blood-money or to demand retaliation."A man from Yemen named Abu Shah stood up and said, "Write it down for me, Messenger of Allah."The Messenger of Allah ﷺ said, "Write it down for Abu Shah."Then a man from Quraysh stood up and said, "Messenger of Allah, except for the idhkhir grass, for we use it in our houses and our graves."The Messenger of Allah ﷺ said, "Except for the idhkhir."Ubaydullah followed him in this narration from Shayban regarding the elephant. Some narrators reported from Abu Naeem with the wording "the killing." Ubaydullah said, "Either the family of the slain be given the right of retaliation."

حدثنا أبو نعيم حدثنا شيبان عن يحيى عن أبي سلمة

عن أبي هريرة

أن خزاعة قتلوا رجلا وقال عبد الله بن رجاء حدثنا حرب عن يحيى حدثنا أبو سلمة حدثنا أبو هريرة أنه عام فتح مكة قتلت خزاعة رجلا من بني ليث بقتيل لهم في الجاهلية فقام رسول الله ﷺ فقال إن الله حبس عن مكة الفيل وسلط عليهم رسوله والمؤمنين ألا وإنها لم تحل لأحد قبلي ولا تحل لأحد بعدي ألا وإنما أحلت لي ساعة من نهار ألا وإنها ساعتي هذه حرام لا يختلى شوكها ولا يعضد شجرها ولا يلتقط ساقطتها إلا منشد ومن قتل له قتيل فهو بخير النظرين إما يودى وإما يقاد فقام رجل من أهل اليمن يقال له أبو شاه فقال اكتب لي يا رسول الله فقال رسول الله ﷺ اكتبوا لأبي شاه ثم قام رجل من قريش فقال يا رسول الله إلا الإذخر فإنما نجعله في بيوتنا وقبورنا فقال رسول الله ﷺ إلا الإذخر وتابعه عبيد الله عن شيبان في الفيل قال بعضهم عن أبي نعيم القتل وقال عبيد الله إما أن يقاد أهل القتيل
