We were with the Prophet ﷺ when a man stood up and said, "I implore you by Allah to judge between us according to the Book of Allah."His opponent, who was more knowledgeable than him, then stood up and said, "Judge between us according to the Book of Allah, and grant me permission to speak."The Prophet ﷺ said, "Speak."He said, "My son was a hired worker for this man, and he committed adultery with his wife. I paid a ransom on his behalf of one hundred sheep and a servant. Then I asked Some men of knowledge, and they informed me that my son must receive one hundred lashes and be exiled for a year, while this man's wife must be stoned."The Prophet ﷺ said, "By the One in whose hand my soul is, I shall judge between you according to the Book of Allah, exalted is His mention. The hundred sheep and the servant are returned to you, and your son must receive one hundred lashes and be exiled for a year. Unays, go tomorrow to this man's wife, and if she confesses, stone her."He went to her the next day, and she confessed, so he stoned her.I said to Sufyan, "He did not say, 'They informed me that my son must be stoned.'"He replied, "The doubt about that wording comes from Zuhri. Sometimes I included it and sometimes I left it out."
حدثنا علي بن عبد الله حدثنا سفيان قال حفظناه من في الزهري قال أخبرني عبيد الله أنه سمع
كنا عند النبي ﷺ فقام رجل فقال أنشدك الله إلا قضيت بيننا بكتاب الله فقام خصمه وكان أفقه منه فقال اقض بيننا بكتاب الله وأذن لي قال قل قال إن ابني كان عسيفا على هذا فزنى بامرأته فافتديت منه بمائة شاة وخادم ثم سألت رجالا من أهل العلم فأخبروني أن على ابني جلد مائة وتغريب عام وعلى امرأته الرجم فقال النبي ﷺ والذي نفسي بيده لأقضين بينكما بكتاب الله جل ذكره المائة شاة والخادم رد عليك وعلى ابنك جلد مائة وتغريب عام واغد يا أنيس على امرأة هذا فإن اعترفت فارجمها فغدا عليها فاعترفت فرجمها قلت لسفيان لم يقل فأخبروني أن على ابني الرجم فقال الشك فيها من الزهري فربما قلتها وربما سكت
