The polytheists stood in two positions in relation to the Prophet ﷺ and the believers. There were the polytheists of the warring peoples, whom he fought and who fought him, and there were the polytheists who had a treaty, whom he did not fight and who did not fight him.Whenever a woman from the warring people emigrated, she would not be proposed to until she had her menstrual period and then become pure. Once she became pure, marriage became lawful for her. If her husband emigrated before she married, she would be returned to him. If a male or female slave belonging to them emigrated, they were free, and they had the same rights as the emigrants. Then he mentioned, regarding the people of the treaty, something similar to the report of Mujahid. If a male or female slave belonging to the polytheists who had a treaty emigrated, they would not be returned, but their prices would be paid back.
