Malik bin Aws bin Hadathan reported,

Malik bin Aws reported that Umar bin Khattab summoned him. While he was there, Umar's chamberlain Yarfa came in and said, "Would you receive Uthman, Abdul-Rahman, Zubayr and Saad? They are seeking permission to enter.""Yes," said Umar, and he let them in.After a short while Yarfa came again and said, "Would you receive Abbas and Ali? They are seeking permission to enter.""Yes," said Umar.When the two entered, Abbas said, "Commander of the Faithful, decide between me and this man." The two of them were disputing over the property that Allah had granted His Messenger ﷺ from the Banu Nadir. Ali and Abbas began to trade harsh words, and the group said, "Commander of the Faithful, judge between them and relieve each of the other."Umar said, "Take it slowly. I charge you by Allah, by whose permission the heavens and the earth stand firm, do you know that the Messenger of Allah ﷺ said, 'We are not inherited from. What we leave behind is charity'? He meant himself by that."They said, "He did say that."Then Umar turned to Abbas and Ali and said, "I charge you both by Allah, do you know that the Messenger of Allah ﷺ said that?"They said, "Yes."Umar said, "Then let me tell you about this matter. Allah, glorified be He, singled out His Messenger ﷺ in this spoil with something He gave to no one else. He, exalted be His remembrance, said, 'And what Allah gave as spoils to His Messenger from them, you did not spur any horse or riding camel for it' up to His words 'is capable of all things' [Hashr 59:6]. So this was exclusively for the Messenger of Allah ﷺ. Yet, by Allah, he did not hoard it away from you, nor did he keep it for himself at your expense. He gave it to you and distributed it among you until only this portion of the property was left. The Messenger of Allah ﷺ would spend on his household their year's maintenance from this property, and then he would take what remained and put it where the wealth of Allah is put. The Messenger of Allah ﷺ did this throughout his life."Then the Prophet ﷺ died, and Abu Bakr said, 'I am now the guardian of what belonged to the Messenger of Allah ﷺ.' So Abu Bakr took charge of it, and he handled it exactly as the Messenger of Allah ﷺ had handled it, and you two were present then."Then he turned to Ali and Abbas and said, "You both mention that Abu Bakr was in this matter as you claim, but Allah knows that in it he was truthful, dutiful, rightly guided and a follower of the truth. Then Allah took Abu Bakr, and I said, 'I am now the guardian of what belonged to the Messenger of Allah ﷺ and to Abu Bakr.' So I took charge of it for two years of my rule, handling it as the Messenger of Allah ﷺ and Abu Bakr had handled it, and Allah knows that in it I am truthful, dutiful, rightly guided and a follower of the truth."Then you both came to me, your words identical and your purpose one. You came to me," meaning Abbas, "and I said to you both that the Messenger of Allah ﷺ had said, 'We are not inherited from. What we leave behind is charity.' Then, when it seemed right to me to hand it over to you, I said, 'If you both wish, I will hand it over to you on the condition that you take upon yourselves the covenant and pledge of Allah that you will handle it as the Messenger of Allah ﷺ and Abu Bakr handled it, and as I have handled it since I took office. Otherwise, do not speak to me about it.' You said, 'Hand it over to us on those terms,' and so I handed it over to you."Do you now seek some other ruling from me? By Allah, by whose permission the heavens and the earth stand firm, I will give no ruling on it other than that until the Hour comes. If you two are unable to manage it, then hand it back to me and I will take care of it for you."

حدثنا أبو اليمان أخبرنا شعيب عن الزهري قال

أخبرني مالك بن أوس بن الحدثان النصري

أن عمر بن الخطاب رضي الله عنه دعاه إذ جاءه حاجبه يرفا فقال هل لك في عثمان وعبد الرحمن والزبير وسعد يستأذنون فقال نعم فأدخلهم فلبث قليلا ثم جاء فقال هل لك في عباس وعلي يستأذنان قال نعم فلما دخلا قال عباس يا أمير المؤمنين اقض بيني وبين هذا وهما يختصمان في الذي أفاء الله على رسوله ﷺ من بني النضير فاستب علي وعباس فقال الرهط يا أمير المؤمنين اقض بينهما وأرح أحدهما من الآخر فقال عمر اتئدوا أنشدكم بالله الذي بإذنه تقوم السماء والأرض هل تعلمون أن رسول الله ﷺ قال لا نورث ما تركنا صدقة يريد بذلك نفسه قالوا قد قال ذلك فأقبل عمر على عباس وعلي فقال أنشدكما بالله هل تعلمان أن رسول الله ﷺ قد قال ذلك قالا نعم قال فإني أحدثكم عن هذا الأمر إن الله سبحانه كان خص رسوله ﷺ في هذا الفيء بشيء لم يعطه أحدا غيره فقال جل ذكره {وما أفاء الله على رسوله منهم فما أوجفتم عليه من خيل ولا ركاب} إلى قوله {قدير} فكانت هذه خالصة لرسول الله ﷺ ثم والله ما احتازها دونكم ولا استأثرها عليكم لقد أعطاكموها وقسمها فيكم حتى بقي هذا المال منها فكان رسول الله ﷺ ينفق على أهله نفقة سنتهم من هذا المال ثم يأخذ ما بقي فيجعله مجعل مال الله فعمل ذلك رسول الله ﷺ حياته ثم توفي النبي ﷺ فقال أبو بكر فأنا ولي رسول الله ﷺ فقبضه أبو بكر فعمل فيه بما عمل به رسول الله ﷺ وأنتم حينئذ فأقبل على علي وعباس وقال تذكران أن أبا بكر فيه كما تقولان والله يعلم إنه فيه لصادق بار راشد تابع للحق ثم توفى الله أبا بكر فقلت أنا ولي رسول الله ﷺ وأبي بكر فقبضته سنتين من إمارتي أعمل فيه بما عمل فيه رسول الله ﷺ وأبو بكر والله يعلم أني فيه صادق بار راشد تابع للحق ثم جئتماني كلاكما وكلمتكما واحدة وأمركما جميع فجئتني يعني عباسا فقلت لكما إن رسول الله ﷺ قال لا نورث ما تركنا صدقة فلما بدا لي أن أدفعه إليكما قلت إن شئتما دفعته إليكما على أن عليكما عهد الله وميثاقه لتعملان فيه بما عمل فيه رسول الله ﷺ وأبو بكر وما عملت فيه منذ وليت وإلا فلا تكلماني فقلتما ادفعه إلينا بذلك فدفعته إليكما أفتلتمسان مني قضاء غير ذلك فوالله الذي بإذنه تقوم السماء والأرض لا أقضي فيه بقضاء غير ذلك حتى تقوم الساعة فإن عجزتما عنه فادفعا إلي فأنا أكفيكماه
