A woman from Khathaam came during the year of the Farewell Pilgrimage and said, "Messenger of Allah, the obligation of Allah upon His servants regarding the Hajj has come due upon my father as a very old man who cannot sit upright on a mount. Will it suffice him if I perform the Hajj on his behalf?"He replied, "Yes."
He narrated the hadith of Ibn Jurayj from Zuhri from Sulayman bin Yasar from Ibn Abbas from Fadl, and said, Hajjaj said, from Ibn Jurayj, "I was told, from Zuhri." If this is accurately recorded, then he has corrupted the chain. We also agreed on this, so both of them narrated the hadith of Ibn Jurayj from Zuhri from Sulayman bin Yasar from Ibn Abbas from his brother Fadl, the hadith of the Khathami woman. Bukhari narrated it from Abu Asim, and Muslim narrated it from Ali bin Khashram from Isa from Ibn Jurayj, both of them saying it was from Zuhri. Maamar and Uzai made it stop at the companion, but the two of them did not narrate it from those two.As for the hadith which they both narrated from Ibn Jurayj, Hajjaj said in it, from Ibn Jurayj, "I was told, from Zuhri."As for Malik and those who followed him, they do not mention it from Fadl. They only said that Fadl was riding behind the Prophet, peace and blessings be upon him and his family, so in their version it became part of the musnad of Abdullah bin Abbas. Nisaburi related it to us from Ibn Raja from Hajjaj from Ibn Jurayj, "I was told, from Zuhri."
The Hafiz said in the introduction to Fath al-Bari, page 358, after mentioning the statement of Daraqutni,"I say, the hadith is recorded by both of them (Bukhari and Muslim) through the narration of Malik and others from Zuhri, so the reliance in it is not on Ibn Jurayj alone. Moreover, Hajjaj was not followed in this wording by anyone else, except that he was a reliable memorizer (hafiz), while Ibn Jurayj was a mudallis. So the narration of Hajjaj should be relied upon until a narration is found from someone other than him from Ibn Jurayj that explicitly states hearing it directly from Zuhri, for I have not seen it from his hadith except with the anaan formula. And Allah knows best." End of quote.
I say, Malik's hadith places it in the musnad of Abdullah bin Abbas, and does not place it in the musnad of Fadl, as it appears in Ibn Jurayj's narration. However, Ahmad narrated in his Musnad, vol. 1, p. 212, via the route of Abdul-Razzaq, who said, Mamar informed us, from Zuhri, from Sulayman bin Yasar, from Ibn Abbas, who said, Fadl bin Abbas told me, and then he related it.
