Bukhari 1488

Both of them (Bukhari and Muslim) narrated the hadith of Malik, from Humayd, from Anas, that the Prophet, peace and blessings be upon him and his family, forbade selling fruits until they ripen. It was asked, "What does ripening mean?" He said, "Until they turn red." The Prophet, peace and blessings be upon him and his family, said, "What do you think, if Allah withholds the fruit, on what basis would one of you take his brother's money?"He said, a group of narrators differed from Malik, among them Ismail bin Jafar, Ibn Mubarak, Hushaym, Marwan, Yazid bin Harun, and others. They reported it with the wording, Anas said, "What do you think, if Allah withholds the fruit?"Both of them also narrated the hadith of Ismail bin Jafar, from Humayd. He separated the words of Anas from the words of the Prophet, peace and blessings be upon him and his family.

The Hafiz said in Fath [Bari], volume 4, page 398, printing S, regarding his statement, "Do you see that, if Allah withholds the fruit" and the rest of the hadith, Malik explicitly related this sentence as a raised report (marfu), and Muhammad bin Abbad followed him in this from Darawardi from Humayd, restricting himself to this final sentence. Daraqutni and more than one of the hadith masters have stated definitively that he erred in this. Ibn Abu Hatim likewise stated this definitively in al-Ilal, citing his father and Abu Zura. The error lies in the narration of Abdul-Aziz, not Muhammad bin Abbad, for Ibrahim bin Hamza related it from Darawardi in the same manner as the narration of Ismail bin Jafar mentioned below.The Hafiz said in Talkhis Habir, volume 3, page 28, "I have explained in al-Mudraj that this sentence, meaning the one in Malik's hadith, is actually a stopped report (mawquf) from the saying of Anas, and that raising it to the Prophet is a mistake, and the clarification of this is found in Muslim."
