Urwa reported that he heard Marwan bin Hakam and Miswar bin Makhrama narrate accounts from the affair of the Messenger of Allah ﷺ during the Umrah of Hudaybiyah. Among what Urwa related from the two of them was the following.When the Messenger of Allah ﷺ was drafting the treaty with Suhayl bin Amr on the day of Hudaybiyah concerning the terms of the truce, one of the conditions Suhayl bin Amr stipulated was, "No one from our side shall come to you, even if he follows your religion, without your returning him to us and leaving him to us."The believers found this condition repugnant and were distressed by it, and they spoke out against it. But since Suhayl refused to settle the treaty with the Messenger of Allah ﷺ except on these terms, the Messenger of Allah ﷺ concluded the agreement with him.That very day, the Messenger of Allah ﷺ returned Abu Jandal bin Suhayl to his father Suhayl bin Amr. During that period, no man came to the Messenger of Allah ﷺ without being sent back, even if he was a Muslim.Then the believing women came as emigrants. Umm Kulthum bint Uqba bin Abu Muayt was among those who set out to the Messenger of Allah ﷺ, and she was a young unmarried woman. Her family came asking the Messenger of Allah ﷺ to return her to them, until Allah Most High revealed concerning the believing women what He revealed.
أنه سمع مروان بن الحكم، والمسوربن مخرمة بخبران خبرا من خبر رسول الله ﷺ في عمرة الحديبة، فكان فيما أخبرني عروة عنهما: أنه لما كاتب رسول الله ﷺ سهيل بن عمرو، يوم الحديبية على قضية المدة، وكان فيما اشترط سهيل بن عمرو أنه قال: لا يأتيك منا أحد وإن كان على دينك إلا رددته إلينا، وخليت بيننا وبينه. وأبى سهيل أن يقاضي رسول الله ﷺ إلا على ذلك، فكرة المؤمنون ذلك وامعضوا فتكلموا فيه، فلما أبي سهيل أن يقاضي رسول الله ﷺ إلا على ذلك، كاتبه رسول الله ﷺ، فرد رسول الله ﷺ أبا جندل بن سهيل يومئذ إلى أبيه سهيل بن عمرو، ولم يأت رسول الله ﷺ أحد من الرجال الأرده في تلك المدة، وإن كان مسلما، وجاءت المؤمنات مهاجرات، فكانت أم كلثوم بنت عقبة بن معيط ممن خرج إلى رسول الله ﷺ وهي عاتق، فجاء أهلها يسألون رسول الله ﷺ أن يرجعها إليهم، حتى أنزل الله تعالى في المؤمنات ما أنزل.
Bukhari narrated this in the Book of Maghazi (4180, 4181) from Ishaq (he is Ibn Rahawayh), Yaqub (he is Ibn Ibrahim bin Saeed) informed us, the nephew of Ibn Shihab (he is Muhammad bin Abdullah bin Milhem bin Shihab) narrated to me from his uncle (he is Zuhri), Urwa bin Zubayr informed me, and he mentioned it.This is connected by mention from the companions of the Messenger of Allah ﷺ as in Sahih Bukhari (2711, 2712).His saying, "until Allah, exalted is He, revealed concerning the believing women what He revealed," refers to His saying, Most High,"O you who believe, when believing women come to you as migrants, examine them. Allah is most knowing of their faith. If you find them to be believers, do not return them to the disbelievers. They are not lawful for the disbelievers, nor are the disbelievers lawful for them" [Mumtahina 60:10]
