When the emigrants arrived in Madinah from Makkah, they came with nothing in their hands, while the Ansar were the people of land and property. So the Ansar shared with them on the basis that they would give them half the fruits of their estates each year, in exchange for the emigrants sparing them the labor and expense.Umm Anas bin Malik, who was called Umm Sulaym and was also the mother of Abdullah bin Abu Talha, Anas's maternal brother, had given the Messenger of Allah ﷺ some date palms of hers. The Messenger of Allah ﷺ then gave them to Umm Ayman, his freedwoman, the mother of Usama bin Zayd.Ibn Shihab said, Anas bin Malik informed me that when the Messenger of Allah ﷺ finished fighting the people of Khaybar and returned to Madinah, the emigrants returned to the Ansar the gifts of fruit-bearing trees they had previously been granted. So the Messenger of Allah ﷺ returned my mother's date palms to her and gave Umm Ayman trees of equal value from his own grove.Ibn Shihab said, As for Umm Ayman, the mother of Usama bin Zayd, she had been a servant girl of Abdullah bin Abdul-Muttalib and was of Abyssinian origin. When Aminah gave birth to the Messenger of Allah ﷺ after his father had passed away, Umm Ayman nursed and cared for him until he grew up. He then freed her and gave her in marriage to Zayd bin Haritha. She died five months after the Messenger of Allah ﷺ passed away.
لما قدم المهاجرون من مكة المدينة قدموا وليس بأيديهم شيء، وكان الأنصار أهل الأرض والعقار، فقاسمهم الأنصار على أن أعطوهم أنصاف ثمار أموالهم، كل عام، ويكفونهم العمل والمؤونة. وكانت أم أنس بن مالك، وهي تدعى أم سليم، وكانت أم عبد الله بن أبي طلحة، كان أخا لأنس لأمه، وكانت أعطت أم أنس رسول الله ﷺ عذاقا لها، فأعطاها رسول الله ﷺ أم أيمن، مولاته، أم أسامة بن زيد. قال ابن شهاب: فأخبرني أنس بن مالك، أن رسول الله ﷺ لما فرغ من قتال أهل خيبر، وانصرف إلى المدينة، رد المهاجرون إلى الأنصار منائحهم التي كانوا منحوهم من ثمارهم، قال: فرد رسول الله ﷺ إلى أمي عذاقها، وأعطى رسول الله ﷺ أم أيمن مكانهن من حائطه. قال ابن شهاب: وكان من شأن أم أيمن، أم أسامة بن زيد، أنها كانت وصيفة لعبد الله بن عبد المطلب، وكانت من الحبشة، فلما ولدت آمنة رسول الله ﷺ بعدما توفي أبوه، فكانت أم أيمن تحضنه، حتى كبر رسول الله ﷺ فأعتقها، ثم أنكحها زيد بن حارثة، ثم توفيت بعدما توفي رسول الله ﷺ بخمسة أشهر.
Bukhari related it in the Book of Gifts (2630), and Muslim in the Book of Jihad (1771), both by way of Ibn Wahb, who said, Yunus informed me, from Ibn Shihab, from Anas, who mentioned it. The wording given here is that of Muslim.His saying "al-aqar" here means the palm trees. Zajjaj said, al-aqar refers to anything that has a fixed root, though it is also said that palm trees specifically are called al-aqar. His saying "adhaqan" is the plural of idhq, which means a palm tree.His saying "when he finished with the matter of the people of Khaybar" refers to the return by the migrants to the Ansar of the gifts they had generally received from them. As for the story of Umm Ayman, it occurred during the expulsion of Banu Nadir, as mentioned previously.His saying "the migrants returned to the Ansar" the gifts of fruit that the Ansar had granted them. This is evidence that these were grants of fruit produce, not transfers of ownership of the palm trees themselves. For had they been an outright gift of the trees themselves, the migrants would not have been able to return them, since taking back a gift after it has been received is not permissible, whereas a mere grant of usufruct may be reclaimed whenever the grantor wishes.
