He asked the Messenger of Allah ﷺ, saying, "We live in a cold land, and we rely on a drink made for us from wheat."The Messenger of Allah asked, "Does it intoxicate?"He replied, "Yes."He said, "Then do not drink it."The man repeated his question, and the Messenger of Allah ﷺ asked him, "Does it intoxicate?"He replied, "Yes."He said, "Then do not drink it."The man repeated it a third time, and the Messenger of Allah ﷺ asked him, "Does it intoxicate?"He replied, "Yes."He said, "Then do not drink it."The man said, "But they cannot do without it."He responded, "If they cannot do without it, then fight them."
أنه سأل رسول الله ﷺ فقال: إنا بأرض باردة، وأنا لنستعين بشراب يصنع لنا من القمح. فقال رسول الله: أ يسكر؟ قال: نعم. قال: فلا تشربوه فأعاد عليه فقال له رسول الله ﷺ: أيسكر؟ قال: نعم، قال: فلا تشربوه فأعاد عليه الثالثة. فقال له رسول الله ﷺ: أيسكر؟ قال: نعم، قال: فلا تشربوه قال: فإنهم لا يصبرون عنه. قال: فإن لم يصبروا عنه فاقتلهم
Ahmad (18034) and Tabarani in Al-Kabir (4/269) both narrated it from the hadith of Abdul-Hameed bin Jafar, who said, Yazid bin Abu Habib told us, Marthad bin Abdullah Yazani told us, he said, Daylam told us the story as mentioned. Its chain is sahih. Daylam is Ibn Hawshab Himyari Yamani, who came to visit the Prophet ﷺ from Yemen.Ahmad (18035) also narrated it from Muhammad bin Ubayd, who said, Muhammad bin Ishaq told us, from Yazid bin Abu Habib, from Marthad bin Abdullah, from Daylam Himyari, who said, I asked the Messenger of Allah ﷺ, saying, "Messenger of Allah, we are in a cold land, and we do hard labor there. We make a drink from this wheat to give us strength for our work and against the cold of our land." He said, "Does it intoxicate?" I said, "Yes." He said, "Then avoid it." He said, then I came before him again and said the same thing to him. He said, "Does it intoxicate?" I said, "Yes." He said, "Then avoid it." I said, "The people will not give it up." He said, "If they will not give it up, then kill them."Bayhaqi (8/292) narrated it through the route of Ahmad's teacher, and at the end of it he said, "Abdul-Hameed bin Jafar likewise narrated it, from Yazid bin Abu Habib."Abu Dawud (3683) narrated it through the route of Muhammad bin Ishaq, except that he mentioned the killing on the second occasion instead. Muhammad bin Ishaq is a mudallis, and here he has used ambiguous transmission wording (anaa).
