Ubaydullah bin Adi bin Khiyar reported that Miswar bin Makhrama and Abdul-Rahman bin Aswad bin Abd Yaghuth said to him, "What prevents you from speaking to your maternal uncle Uthman about his brother Walid bin Uqba? People have been saying a great deal about what he has done."Ubaydullah said, "So I positioned myself to meet Uthman as he came out for the prayer, and I said to him, 'I have a matter to bring to you, and it is sincere advice.'"He replied, "Man, I seek refuge in Allah from you."So I left. When the prayer was over, I sat with Miswar and Ibn Abd Yaghuth and told them what I had said to Uthman and what he had said to me. They said, "You have done what was incumbent upon you."While I was sitting with them, a messenger from Uthman came to me. They said to me, "Allah has tested you."So I went and entered upon him. He said, "What is the advice you mentioned earlier?"I said, "I bear witness that there is no god but Allah," then I said, "Allah sent Muhammad ﷺ and revealed to him the Book. You were among those who responded to Allah and His Messenger ﷺ. You believed in him and made the first two emigrations, accompanied the Messenger of Allah ﷺ, and witnessed his guidance. People have been saying a great deal about Walid bin Uqba, and it is your duty to carry out the prescribed punishment upon him."He said to me, "My nephew, did you meet the Messenger of Allah ﷺ?"I said, "No, but knowledge of him has reached me as it has reached the virgin in her seclusion."Uthman bore witness to the faith, then said, "Allah sent Muhammad ﷺ with the truth and revealed to him the Book. I was among those who responded to Allah and His Messenger ﷺ, and I believed in what Muhammad ﷺ was sent with. I made the first two emigrations as you said, accompanied the Messenger of Allah, and pledged allegiance to him. By Allah, I never disobeyed him nor deceived him until Allah took his soul. Then Allah made Abu Bakr the caliph, and by Allah, I never disobeyed him nor deceived him. Then Umar was made caliph, and by Allah, I never disobeyed him nor deceived him. Then I was made caliph. Do I not have the same right over you that they had over me?"He said, "Yes."Uthman said, "Then what are these reports that reach me about you all? As for what you mentioned regarding Walid bin Uqba, we shall, Allah willing, take the right course in his case."He then had Walid flogged forty lashes, ordering Ali to flog him, and Ali himself carried out the flogging.
أن عبيد الله بن عدي بن الخيار أخبره أن المسور بن مخرمة وعبد الرحمن بن الأسود بن عبد يغوث قالا له: ما يمنعك أن تكلم خالك عثمان في أخيه الوليد بن عقبة، وكان أكثر الناس فيما فعل به، قال عبيد الله: فانتصبت لعثمان حين خرج إلى الصلاة فقلت له: إن لي إليك حاجة وهي نصيحة فقال: أيها المرء أعوذ بالله منك فانصرفت، فلما قضيت الصلاة، جلست إلى المسور وإلى ابن عبد يغوث فحدثتهما بالذي قلت لعثمان وقال لي، فقالا: قد قضيت الذي كان عليك فبينما أنا جالس معهما إذ جاءني رسول عثمان، فقالا لي: قد ابتلاك الله. فانطلقت حتى دخلت عليه فقال: ما نصيحتك التي ذكرت آنفا قال: فتشهدت ثم قلت: إن الله بعث محمد ﷺ وأنزل عليه الكتاب، وكنت ممن استجاب الله ورسوله ﷺ و آمنت به وهاجرت الهجرتين الأوليين وصحبت رسول الله ﷺ، ورأيت هديه وقد أكثر الناس في شأن الوليد بن عقبة، فحق عليك أن تقيم عليه الحد. فقال لي: يا ابن أخي ادركت رسول الله ﷺ؟ قال: قلت: لا ولكن قد خلص إلي من علمه ما خلص إلى العذراء في سترها. قال: فتشهد عثمان فقال: إن الله قد بعث محمدا ﷺ بالحق وأنزل عليه الكتاب وكنت ممن استجاب الله و رسوله ﷺ وآمنت بما بعث به محمد ﷺ، وهاجرت الهجرتين الأوليين كما قلت، وصحبت رسول الله وبايعته، والله ما عصيته، ولا غششته حتى توفاه الله ثم استخلف الله أبا بكر، فوالله ما عصيته ولا غششته، ثم استخلف عمر فوالله ما عصيته ولا غششته، ثم استخلفت، أفليس لي عليكم مثل الذي كان لهم علي؟ قال: بلى قال: فما هذه الأحاديث التي تبلغني عنكم؟ فأما ما ذكرت من شأن الوليد بن عقبة فسنأخذ فيه إن شاء الله بالحق. قال: فجلد الوليد أربعين جلدة، وأمر عليا أن يجلده، وكان هو يجلده.
Bukhari narrated it in the chapter on the merits of the Ansar (3872), from Abdullah bin Muhammad Jafi, who said, Hisham told us, Mamar informed us, from Zuhri, Urwa bin Zubayr told us, and he related it.He also narrated it in the chapter on the merits of the companions (3696), from Ahmad bin Shabib bin Saeed, who said, my father told me, from Yunus, from Ibn Shihab, with a similar wording, except that he said, "Then he called for Ali and ordered him to administer the lashing, so he lashed him eighty times."His statement, "so he lashed him eighty times," is a mistake by Yunus bin Yazid Ayli, and the correct version is what Mamar narrated, that he lashed him forty times.Imam Ahmad said, Yunus makes many errors when narrating from Zuhri. He was asked, who was most reliable in narrating from Zuhri, and he said, Mamar. He was asked, what about Yunus? He said, he narrated hadiths that are objectionable.
