The Prophet of Allah ﷺ flogged people for drinking wine using palm branches and sandals, then Abu Bakr flogged forty lashes. When Umar came to power and people drew near to the countryside and villages, he asked, "What is your view regarding the flogging for wine?"Abd al-Rahman bin Awf replied, "I think you should make it like the lightest of the prescribed punishments."So Umar flogged eighty lashes.
أن نبي الله ﷺ جلد في الخمر بالجريد والنعال، ثم جلد أبو بكر أربعين، فلما كان عمر، ودنا الناس من الريف والقرى قال: ما ترون في جلد الخمر؟ فقال عبد الرحمن بن عوف: أرى أن تجعلها كأخف الحدود، قال: فجلد عمر ثمانين.
Muslim narrated it in the Hudud (1706:36) from Muhammad bin Muthanna, who said, Muaz bin Hisham narrated to us, who said, my father narrated to me, from Qatada, from Anas, and he mentioned it.His saying, "the countryside," means land of cultivation and fertility, and its plural is "countrysides." He means by this that when the lands of Sham and Iraq were conquered, grapevines became abundant, and the drinking of wine appeared among the people. So Umar consulted the companions about tightening the punishment for the wine drinker, and they agreed to attach it to the punishment for slander, since that was the lightest of the fixed punishments, as Abdul-Rahman bin Awf said.In the Muwatta, in the Book of Drinks (2), it is reported that when Umar consulted them about this, Ali bin Abu Talib said, "We think you should flog him eighty lashes, for when he drinks he becomes intoxicated, and when he becomes intoxicated he raves, and when he raves he slanders."
